Welcome to NearMeHub.sg

By accessing or using this website and platform (the “Site”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use this Site.

1. Description of Service

NearMeHub.sg is a local business listing platform that connects customers with service providers in specific Singapore neighbourhoods. The Site allows businesses to purchase monthly listings to appear in curated directories organized by niche (e.g., dentist, plumber, lawyer) and neighbourhood (e.g., Tampines, Bedok, Jurong East).

2. Listing Eligibility and Requirements

2.1 Business Eligibility

Your business must be legally registered and operating in Singapore
Your business must provide services or products in the niche category for which you are listing
You must have a valid Singapore business registration number or equivalent
You must comply with all applicable Singapore laws and regulations

2.2 Listing Information

All information provided in your listing must be accurate, complete, and current
You are responsible for updating your listing information promptly if any details change
You may not misrepresent your business, services, qualifications, or credentials
You may not include false, misleading, or defamatory content in your listing

2.3 Prohibited Content

You may not include in your listing:

Illegal content or services
Sexually explicit or offensive material
Hate speech or discriminatory content
Content that infringes on intellectual property rights
Contact information for competing platforms or services
Spam, malware, or harmful code
False claims about certifications, licenses, or qualifications

3. Listing Limits and Scarcity Model

3.1 Maximum Listings Per Niche-Neighbourhood Combination

A maximum of 5 business listings are available for each niche-neighbourhood combination (e.g., “Dentist Tampines”)
Once 5 listings are filled, no additional listings will be accepted for that niche-neighbourhood combination
Businesses may join a waitlist to be notified when a spot becomes available

3.2 Multiple Listings

A single business may purchase multiple listings across different niches or neighbourhoods
A single business may not purchase more than one listing for the same niche-neighbourhood combination
If a business operates under multiple brand names or legal entities, each may purchase a separate listing

3.3 Listing Availability

Listing availability is displayed in real-time on the Site
Listings are allocated on a first-come, first-served basis
NearMeHub.sg reserves the right to remove listings that violate these Terms

4. Subscription and Payment

4.1 Subscription Model

Listings are available on a monthly subscription basis
The current subscription fee is S$50-150/month, depending on the niche category
Subscription fees are non-refundable once the listing is published
Subscription fees are charged monthly in advance

4.2 Payment Terms

Payment must be made via the payment methods available on the Site
You authorize NearMeHub.sg to charge your payment method on a recurring monthly basis
If payment fails, your listing may be suspended until payment is received
Failure to pay may result in account termination and removal of your listing

4.3 Price Changes

NearMeHub.sg reserves the right to change subscription fees with 30 days’ notice
Price changes will not apply to existing subscriptions until the next renewal date
You will be notified of price changes via email

4.4 Cancellation

You may cancel your subscription at any time
Cancellation takes effect at the end of the current billing cycle
No refunds will be issued for partial months
Upon cancellation, your listing will be removed from the Site

5. Intellectual Property

5.1 Site Content

All content on the Site, including logos, images, text, design, and software, is the property of NearMeHub.sg or its licensors; with the exception of business listing content
This content is protected by copyright and trademark laws
You may not reproduce, distribute, or modify Site content without prior written permission

5.2 Your Listing Content

You retain ownership of the content you provide in your business listing
By publishing your listing on the Site, you grant NearMeHub.sg a non-exclusive, royalty-free license to use, display, and distribute your listing content for the purpose of operating the platform
You warrant that you own or have the right to use all content in your listing

5.3 Customer Reviews and Feedback

Customers may leave reviews and ratings for your business on the Site
Reviews are the property of NearMeHub.sg and the customers who submitted them
NearMeHub.sg may display, modify, or remove reviews at its discretion
You may not post fake reviews or manipulate review ratings

6. Limitation of Liability and Disclaimers

6.1 No Guarantee of Results

NearMeHub.sg does not guarantee that your listing will generate customer inquiries or sales
NearMeHub.sg does not guarantee specific traffic levels, conversion rates, or revenue
Your business results depend on many factors beyond NearMeHub.sg’s control, including market conditions, competition, and customer demand

6.2 Accuracy of Information

While we strive to maintain accurate information on the Site, NearMeHub.sg does not guarantee the accuracy or completeness of any content
You are responsible for verifying the accuracy of information about other businesses on the Site
NearMeHub.sg is not liable for inaccurate or incomplete information provided by businesses

6.3 Third-Party Content

The Site may contain links to third-party websites and services
NearMeHub.sg is not responsible for the content, accuracy, or practices of third-party websites
Your use of third-party websites is at your own risk and subject to their terms of service

6.4 “As Is” Disclaimer

The Site is provided “as is” without warranties of any kind, express or implied
NearMeHub.sg does not warrant that the Site will be uninterrupted, error-free, or secure
NearMeHub.sg does not warrant that defects will be corrected or that the Site is free of viruses or harmful code

6.5 Limitation of Liability

To the fullest extent permitted by law, NearMeHub.sg shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site
This includes damages for loss of profits, revenue, data, or business opportunities
NearMeHub.sg’s total liability shall not exceed the amount you paid for your subscription in the 12 months preceding the claim

7. Indemnification

You agree to indemnify and hold harmless NearMeHub.sg, its officers, employees, and agents from any claims, damages, or costs arising from:

Your violation of these Terms
Your use of the Site
Your listing content or business practices
Any dispute between you and a customer
Your violation of applicable laws or regulations

8. Dispute Resolution

8.1 Customer Disputes

NearMeHub.sg is not responsible for disputes between your business and customers
You are responsible for handling all customer complaints and disputes
NearMeHub.sg may remove your listing if we receive multiple complaints about your business

8.2 Listing Disputes

If another business disputes your right to a listing, NearMeHub.sg will investigate
NearMeHub.sg reserves the right to remove listings that violate these Terms or applicable laws
Decisions regarding listing disputes are final

8.3 Arbitration

Any disputes arising from these Terms or your use of the Site shall be resolved through binding arbitration
Arbitration shall be conducted in Singapore under the rules of the Singapore International Arbitration Centre (SIAC)
You waive your right to pursue disputes through the courts

9. Prohibited Conduct

You may not:

Violate any applicable Singapore laws or regulations
Infringe on the intellectual property rights of others
Transmit any harmful, malicious, or illegal code
Attempt to gain unauthorized access to the Site or other users’ accounts
Engage in fraudulent or deceptive practices
Post false, misleading, or defamatory content
Harass, threaten, or abuse other users or NearMeHub.sg staff
Spam or send unsolicited communications
Scrape, crawl, or automatically access the Site without permission
Manipulate search results or listing rankings through artificial means

10. Suspension and Termination

10.1 Suspension

NearMeHub.sg may suspend your account and listing if:
- You violate these Terms
- Payment is not received
- We receive complaints about your business practices
- Your listing contains prohibited content
- Your business no longer meets eligibility requirements

10.2 Termination

NearMeHub.sg may terminate your account if:
- Violations of these Terms are serious or repeated
- Your business is involved in illegal activity
- You pose a risk to other users or the platform
- Your business is no longer operating

10.3 Effect of Suspension or Termination

Upon suspension or termination, your listing will be removed from the Site
No refunds will be issued
You may not create a new account to circumvent suspension or termination

11. Data Privacy and Security

11.1 Personal Data

NearMeHub.sg collects and processes personal data in accordance with the Singapore Personal Data Protection Act (PDPA)
Your personal data will be used to operate the platform, process payments, and communicate with you
We will not sell or share your personal data with third parties without your consent

11.2 Security

NearMeHub.sg implements reasonable security measures to protect your data
However, we do not guarantee that the Site is completely secure
You are responsible for maintaining the confidentiality of your account credentials

12. Changes to Terms

NearMeHub.sg reserves the right to modify these Terms at any time
Changes will be effective immediately upon posting to the Site
Continued use of the Site after changes constitutes your acceptance of the new Terms
We will notify you of material changes via email

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law principles.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement
